Terms of Service

These terms govern your use of the AmazingForms plugin and related services. By purchasing a licence or activating the plugin, you agree to these terms. Please read them — they're written to be understandable, not to obscure anything important.

1. What you're buying

You are purchasing a software licence — the right to use the AmazingForms WordPress plugin on a defined number of sites for the licence period you've paid for. You are not purchasing a physical product, and there is nothing to ship. The plugin is delivered as a download immediately after purchase.

Pro licences include access to our managed AI proxy service during the licence period, within the fair-use limits described in section 3.

A "site" means a single WordPress installation with a unique domain or subdomain. Staging and local development environments used for the same production site do not count toward your site limit.

Licences are non-transferable and may not be resold or shared with third parties. You may not use a single licence to power forms on behalf of multiple clients (that would require multiple licences or the Agency plan).

3. What we provide

Your licence includes:

  • The plugin — AmazingForms and all modules included in your plan tier, delivered as a WordPress plugin zip.
  • Updates — bug fixes, security patches, and new features for the duration of your licence period.
  • Support — access to our support system for licence-related issues and plugin bugs. We aim to respond within 2 business days.
  • Managed AI credits — access to our managed AI proxy within fair-use limits. Fair use is defined as usage consistent with normal single-business operation; we reserve the right to contact you if usage is unusually high and to apply metered overage charges for sustained high volume (we will notify you before doing so).

4. What you agree to

By using AmazingForms, you agree:

  • No resale — you will not resell, sublicence, or distribute the plugin or your access to the managed AI proxy.
  • No proxy abuse — you will not attempt to use the managed AI proxy in ways that violate our usage policy, including generating illegal content, attempting to extract training data, or deliberately triggering excessive API usage.
  • Legal use only — you will not use AmazingForms to collect data unlawfully, send spam, engage in phishing, or violate any applicable law.
  • Accurate information — you will provide accurate contact and billing information when purchasing.
  • Site owner responsibility — you are responsible for complying with data protection laws (GDPR, CCPA, etc.) in how you collect and use data from forms on your site. AmazingForms provides tools; you decide what data you collect and from whom.

5. Managed AI proxy uptime

We aim for 99.9% availability of the managed AI proxy. However, we do not offer a formal SLA at this stage of the product. Managed AI is dependent on upstream providers (currently Anthropic); planned and unplanned downtime on their side may affect availability.

If the managed AI proxy is unavailable, your forms will continue to accept and store submissions normally — only the agentic post-submission processing will be delayed until service is restored.

6. Termination

You may cancel your licence at any time. Cancellation stops renewal. You retain access to the plugin and managed AI until the end of your current paid period. We do not pro-rate refunds for mid-period cancellation (see our Refund Policy for the 14-day new-purchase guarantee).

We may terminate your licence with 30 days' notice for any reason, or immediately if you materially breach these terms (e.g., resale or proxy abuse). If we discontinue the AmazingForms service entirely, we will give at least 60 days' notice and provide a mechanism to export your data.

7. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising from your use of AmazingForms is capped at the total fees you paid in the 12 months preceding the claim.

We are not liable for indirect, incidental, or consequential damages — including lost profits, lost data, or business interruption — even if we were advised of the possibility of such damages.

Nothing in these terms excludes liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

8. Intellectual property

The AmazingForms plugin code is licensed under the GNU General Public Licence v2 (GPL) or later, consistent with WordPress licensing requirements. This means you are free to inspect, modify, and distribute the plugin code under the GPL — the value of our service is in the managed AI proxy, the corpus, and future fine-tuned models, which are not GPL-licensed.

9. Governing law

These terms are governed by the laws of England and Wales. Any dispute arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Changes to these terms

We will notify active licence holders by email at least 30 days before making material changes to these terms. Continued use of the plugin after the effective date of changes constitutes acceptance of the new terms. If you don't agree with a material change, you may cancel your licence before it takes effect and we will consider a pro-rata refund at our discretion.
